The Heavily Increased Cal/OSHA Penalties for Serious Violations Take Effect

We have alerted members regarding the huge catch-up numbers instituted for some Cal/OSHA Penalties. Previously, willful/serious violations had a maximum penalty of $70,000. The budget bills of 2017 increased this maximum amount to $124,709.
Alhambra Foundry was cited by Cal/OSHA on March 7, 2018; on eight separate violations, with total penalties of $283,390. Two were considered willful/serious because Cal/OSHA had cited the employer in 2009 for the same violations. In the most recent case, an employee's legs were amputated to free the employee from being caught in a conveyor when another employee turned on the air filtration device the conveyor was a part of. This was a violation of both confined space regulations, and lockout-tagout regulations. Due to the prior citations the two willful/serious citations were penalized at $108,000 each. CALPASC members are encouraged to review the following items to minimize their exposure to willful/serious citations.
  1. Confirm your confined space regulations and training are up to date, if applicable.
  2. Confirm your lockout-tagout regulations and training are up to date.
  3. Review any prior Cal/OSHA citations, and ensure to your best ability that those violations can't be repeated.
